Terms of Service Agreement

This Agreement is made, entered into and executed at Greater Noida, Uttar Pradesh, India on 31 May 2020 (hereinafter referred to as the “Effective Date”)

Customer Agreement
All customers must agree to all terms and conditions prior to signing up for any hosting plans and services provided by Yetahost. You agree to use only licensed and legal third-party software in connection with your use of our services. Yetahost reserves the right to suspend or cancel a customer’s access to any or all services at any time, especially if the account is deemed to be inappropriately used or otherwise in violation of these terms.

Content and Use
Yetahost reserves the right to refuse service and/or access to its servers to anyone. The services provided must be used for lawful purposes only. The transmission, storage, or presentation of any information, data, or material in violation of any law or regulation is prohibited.

The following are examples of activities and content that are strictly prohibited:

Topsites, Ponzi schemes, pyramid schemes, prime bank programs, bank debenture trading programs.

Cryptocurrency/Bitcoin Miners, Forex, E-gold: Hosting any mining or trading-related activities.

Proxy services, bots, spam bots, mail bombers, port scanners, IP scanners, brute force scripts.

Mail harvesting scripts, chat rooms, banner rotators, file dumps, or using disk space as secondary storage.

Sales of illegal pharmaceuticals, drugs, explosives, anonymous or bulk SMS gateways, malware, warez, phishing materials.

Lottery, gambling, illegal downloads, pirated software, escrow services, high-yield investment programs.

Adult thumbnail galleries/banner exchanges, streaming or broadcasting live copyrighted events.

Human trafficking or promotion of prostitution: Websites advocating any form of human trafficking or prostitution services will be terminated immediately.

Adult Materials: Yetahost prohibits hosting any adult content that violates Indian laws, including but not limited to:

• Pornography (explicit sexual acts, child exploitation, non-consensual material) under the Information Technology Act, 2000 (Section 67, 67A, 67B) and the Indian Penal Code (Sec 292, 293, 294).
• Obscene material as defined by Indian courts (content deemed "lascivious or prurient" by community standards).
• Sexually explicit content involving minors, revenge porn, or unlawful depictions.

Allowed (with restrictions):
• Educational/Artistic Content: Medical, scientific, or legally permissible adult-themed material (e.g., sex education, documentaries).
• Text-Based Adult Content: Erotic literature or forums, provided they comply with Indian obscenity laws.

Requirements for Permitted Adult Content:
• Age Verification: Medical, scientific, or legally permissible adult-themed material (e.g., sex education, documentaries).
• No Visual Depictions: Erotic literature or forums, provided they comply with Indian obscenity laws.
• Geoblocking: Content must be inaccessible to users in India if it violates local laws.

Enforcement:
• Accounts hosting prohibited adult content will be terminated immediately without notice.
• Yetahost cooperates with Indian authorities under IT Act Section 79 for lawful content removal.

Illegal Materials: This includes copyrighted works, commercial audio, video, or music files, and any material violating regulations or perceived as misleading.

IRC Hosts: Hosting IRC servers that are part of or connected to IRC networks is strictly prohibited. If found, servers will be removed without notice. Repeat violations will result in permanent account termination.

Prohibited Content
Additionally, the following content is strictly forbidden on our hosting services:

Bots: Including IRC or other social bots (e.g., Telegram bots).

Warez: Hosting or distributing copyrighted content without legal rights.

Phishing Content: Fraudulent schemes aimed at stealing sensitive information.

Bulk Mailing: Sending unsolicited bulk emails.

Audio Streaming: Hosting audio streams is not allowed.

Video "Tube" Websites: Hosting video-sharing platforms or services akin to "tube" websites.

IP Scanners and Brute Force Programs: Using tools for network scanning or hacking.

Financial Institution Websites: Hosting websites related to banking, insurance, or investments is not allowed unless explicitly approved with proof of regulatory compliance.

Pharmaceutical Websites: Hosting websites related to pharmaceuticals.

Lottery Sites: Hosting lottery or gambling-related websites.

File Storage: Using hosting space for storing files such as movies, applications, or computer backups.

File Upload Websites: Hosting websites intended for file uploads or file-sharing.

Distribution of Confidential Information: Sharing or distributing personal or confidential information.

Mobile App Downloads: Hosting websites for mobile app downloads.

NextCloud/OpenCloud: Hosting file-sharing platforms like NextCloud or OpenCloud.

Any account found hosting any of the above content or activities will be immediately taken offline.

Cryptocurrency/ Finance Related Website

Yetahost allows the hosting of cryptocurrency/ Finance-related websites, provided that additional verification is completed to ensure the legitimacy of the business. The following information is required for verification:

Verification of the website owner’s identity, including a selfie with a valid ID.

Company name, registration number, and proof of incorporation or business registration.

A copy of the company director’s ID.

Rest assured, any information shared during this process will be handled with the utmost confidentiality and used solely for verification purposes.

Abuse of Resources

Any attempts to compromise or actual compromise of network devices, including port scanning, IP range scanning, and vulnerability scanning, are strictly prohibited. Infractions may result in immediate service termination.

Denial of Service (DOS) attacks directed at Yetahost or launched from its servers are strictly prohibited and may result in immediate termination.

Hosting illegal software, source code, or materials that could be used to commit illegal acts (e.g., hacking tools, viruses) is prohibited and may lead to termination.

Hosting infringing materials, such as pirated content, without consent, or defamatory information is forbidden.

Attempts to undermine or harm servers or cause resource abuse may result in service suspension or termination.

Unsolicited commercial or bulk email (SPAM) is prohibited, and violations may result in severe penalties, including fines and service termination.

Hosting publicly-accessible "open relay" SMTP or anonymous remailers is prohibited

We have a zero-tolerance policy for SPAM. Violations may result in fines of $250 to $1500 for repeated infractions, and severe cases may lead to immediate termination without notice.

Limitation of Liability:

In no event shall Yetahost, its affiliates, or its staff be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to the use of our services. Total liability shall not exceed the amount paid by the customer for the services in question during the prior 6 months.

Service Disclaimers and Limitations:

Yetahost does not guarantee that the services will be error-free or uninterrupted. We are not responsible for any loss or damage resulting from the use or inability to use our services, including but not limited to delays, data loss, or service interruptions caused by third-party providers or client misuse.

Uptime Guarantee

Yetahost offers a 99% Uptime Guarantee. Our engineers monitor our uptime 24/7 using Uptime Robot to ensure this guarantee is met.

However, Yetahost will not be liable for failure or delay in performing its obligations due to circumstances beyond our reasonable control. This includes, but is not limited to, acts of government, war, sabotage, natural disasters, labor disturbances, transportation interruptions, third-party service failures (e.g., DNS propagation), hardware/software failures, or the inability to obtain raw materials or power required for service delivery.

Server Migration / Upgradation and IP Changes

At Yetahost, we regularly conduct server migrations and upgrades to enhance connectivity, performance, and service quality. During these processes, if the server fails or requires adjustments, Yetahost reserves the right to change the IP address or temporarily move the server to a different location that may not have been part of the original plan.

We are committed to minimizing any disruption during this period and will take all necessary steps to ensure services are restored as quickly as possible. Rest assured, we will do everything possible to reduce any impact on your experience and to provide the best service.

Domain Policy [v2 06/2025]

Domain Registration Policy

By registering a domain name through Yetahost, the registrant (customer) agrees to comply with the policies of:

• ICANN (Internet Corporation for Assigned Names and Numbers), and
• the respective domain registry for the selected TLD.

Accurate WHOIS Information

• Registrants must provide accurate, complete, and up-to-date contact information during the domain registration process.
• This includes full name, address, phone number, and email.
• Providing false, incomplete, or misleading WHOIS details may result in:
• Suspension or deletion of the domain,
• A verification request from the registry or ICANN,
• A request for KYC documents (e.g., government-issued ID, utility bill) to verify your identity and address.

Domain Suspensions and Legal Compliance

• Domains found to be involved in illegal activity, spam, phishing, or violations of registry policies may be suspended without prior notice.
• Suspensions may occur directly at the registry level, beyond Yetahost's control.
• Yetahost acts only as a technical facilitator between the registrant and the registry. We do not control suspension timelines or verification outcomes.

Important Notes

• It is solely the registrant’s responsibility to:
• Maintain valid contact details,
• Respond to verification or abuse inquiries,
• Ensure the domain is not misused by third parties for spam, scams, or malicious activities.
• Yetahost is not liable for any losses, delays, or downtime resulting from registry-enforced domain suspension or document verification delays.

Refund Policy [v2 07/2021]

Cancellation and Refund Policy

At Yetahost, we strive to ensure customer satisfaction and provide clear guidelines for cancellations and refunds. If you're considering canceling, we encourage you to first reach out to our support team to address any concerns.

Refund eligibility may be forfeited if any misuse or violation of our services is identified.

Domain registration fees are non-refundable.

Billing and Reactivation Policy [v2 01/2025]

Yetahost services operate on a subscription basis. Invoices must be paid on or before the due date to avoid suspension or termination.

Overdue Accounts:

• Accounts become overdue 3 days after an unpaid invoice and may be suspended without prior notice.

Partial Payments and Reactivation:

• If a customer pays a later-dated invoice (e.g., Feb–Mar) but has prior unpaid invoices (e.g., Jan–Feb), the account may be temporarily reactivated for access. Outstanding dues remain payable.

Grace Period (One-Time Benefit):

• A one-month grace period may be granted for the first overdue event only.
• Reset Condition: The grace period resets only if all pending dues are cleared in full.
• Does NOT apply for recurring late payments.

Repeat Late Payments:

• Accounts with repeat late payments (after grace period exhaustion) will face immediate termination without additional leniency.

[2] Affiliate Obligations

You must not engage in false advertising, deceptive marketing, or misleading claims about Yetahost services.

You may not use spam, phishing, or paid traffic without prior approval.

Use of Yetahost branding or logos must follow our brand guidelines.

Commissions are tracked through our affiliate panel and paid monthly, subject to a minimum payout threshold of ₹50 or equivalent.

Violation of affiliate terms may result in termination and forfeiture of unpaid commissions..

Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the Republic of India. All disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Greater Noida, Uttar Pradesh.
